HOUSING (TAX) CREDIT PROPERTY RESIDENT SELECTION CRITERIA I. THIS COMMUNITY IS INCOME RESTRICTED Average income of the households may not exceed the maximum income limits for the property’s program. Please speak with the Management representative for specific information regarding these income limits. A resident's income cannot exceed the property’s program restrictions of the area median income as published annually by the U.S. Dept. of HUD. II. FAIR HOUSING The Owner and Managing Agent will not discriminate against any individual or household due to race, color, creed, national or ethnic origin or ancestry, religion, sex, sexual orientation, age, disability, handicap, military status, source of income, marital status or presence of children in a household. III. APPLICATION PROCESSING All applications are processed in the order received. The applicant who is first to pay the application fee, remits all required documents, qualifies and pays the required move-in charges after approval will be selected. We continue to process all applications until a deposit is received by applicant. The applicant may place a “hold” deposit on the property to reserve the residence for up to 3 days. Placing a hold on an apartment does not guarantee approval but shall take the selected unit off the market while the application is processed. Applications received when no apartments are available will be put on the waiting list in the order of when the application was received. IV. OCCUPANCY STANDARDS Occupancy guidelines set by Fair Housing will be followed. No more than 2 persons per bedroom and one additional occupant shall occupy any residence. V. AGE RESTRICITIONS The head of household must be 18 years of age or older, or an emancipated minor as required by law. If you are applying to our senior community the head of household must be a minimum of 55 years of age. Documentation must be provided if an emancipated minor is the head of household. VI. VERIFICATION PROCESS A. Financial: 1. All income will be verified in writing from the income source on appropriate project income verification forms. 2. All assets, including bank accounts, will be verified in writing. 3. Income must be at least (2) times the rental rate. Exceptions to this requirement are if applicant can prove that his or her current rent is equal to or greater than the development's rent. At least six months' worth of rent receipts must be verified. 4. Third-party income verification will be required from all sources, including, but not limited to: a) Employment, Unemployment b) Government Assistance, TANF, etc. c) Social Security, Pension, VA Benefits d) Disability e) Savings and checking f) Asset verification, property, home, stocks, bonds, annuities, IRA, etc. 5. Income is calculated based on the applicant's annual gross income. Annual gross income includes income from assets. B. The site administrator or other representative of management will interview all applicants. C. Some pets may be allowed. Please speak to management regarding this sites pet policy. A service dog (a seeing-eye dog or a dog for the deaf) is not considered a pet. D. The applicant is responsible for completing the application accurately. Misrepresentation of information is grounds for disqualification. If for any reason an applicant is rejected, the applicant will be informed in writing. A unit will not be held during an appeal process. E. Every household member (excepting live-in care attendants, foster children or children that are not awarded full custody to the applicant) will be counted when determining qualification. F. Additions to the Household during the initial lease term shall require that the entire household be re-qualified at the initial income limit at the time that occupancy occurred. VII. REJECTED APPLICATIONS A. Applicants may be rejected for any of the following: 1. Blatant disrespect, disruptive, aggressive or anti-social behavior toward the Managing Agent, the Development or other residents exhibited by an applicant or family member any time prior to move-in (or a demonstrable history of such behavior); 2. Behavior and Conduct: A history of behavior which constitutes a direct threat to the health or safety of other individuals will disqualify an applicant. Any applicants who have been convicted of drug-related crimes and/or demonstrated a history of burglary, robbery, vandalism or aggravated assault or other crimes against persons or property will not be accepted; 3. A negative landlord or other reference, encompassing failure to comply with the lease, poor payment history, (NSF checks, late payments), poor housekeeping habits, or eviction for cause during the past 3 years from the date of application; 4. Failure to present all members of the family at the interview (or some other time acceptable to management) prior to completion of Initial Certification; 5. A negative credit report: a) Any open collections or judgments, two or more accounts rated R-9 or equivalent with a different reporting service. b) Unpaid utility bills (gas & electricity) will result in denial. Phone bills & cable bills in excess of $125 must be paid or currently being paid. c) Bankruptcy within last 12 months. If bankruptcy is over 12 months from the date of application, and the bankruptcy has not affected landlords and applicant has established positive credit, the applicant will be considered. 6. Rent exceeding 40% of the applicant’s monthly income; 7. Falsification of any information on the application; 8. Family composition not appropriate for available bedroom size; 9. Failure to update application for the waiting list within specified time when notified; 10. A household comprised in its entirety of Students. There are exceptions to this criteria for specific cases; 11. Changes in Income or Assets prior to move in. If the financial scenario of a household changes after application, but prior to occupancy in a way to effect the household’s ability to pay rent or renders the household now overqualified for the program(s) on the property, this may cause the rejection of the application; 12. Unable to contact Applicant. No less than three attempts shall be made to contact applicant for interview. Failure to respond to contact attempts or failure to appear for scheduled interview appointment; 13. Other good cause: including, but not limited to, failure to meet any of the selection criteria in this document. B. All rejected applicants will have the right to appeal the decision. The appeal must be received by the administrator no later than five (5) days after the rejection letter was sent and will be referred to the administrator’s Supervisor for review. C. Rejected applicants may not reapply for a period of one year. VIII. CONDITIONAL APPROVALS An application with a negative credit report will be considered for approval only if the following conditions are met: A. Approval is possible requiring double the current deposit if the following items are met: 1. Must have a favorable landlord reference for at least 1 year prior to applying. Any unfavorable reference with in the last 3 years will be denied. 2. Must have been at current place of employment or source of income for 1 ½ years, from the date of application. B. Approval with double deposit and co-signor shall also be considered if VIII A 1 & 2 have not been met providing : 1. No negative landlord reference 2. At least six months of continuous employment at current employer or source of income. IX. PROCESSING FEE Each applicant will be charged a nonrefundable application-processing fee of $30.00. This fee will include checking credit, prior rental history, and criminal background checks.
